Chapter 2 | Refusal to Pay zakat

5ـ عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُحَمَّدِ بْنِ الْحَسَنِ بْنِ شَمُّونٍ عَنْ عَبْدِ الله بْنِ عَبْدِ الرَّحْمَنِ عَنْ مَالِكِ بْنِ عَطِيَّةَ عَنْ أَبَانِ بْنِ تَغْلِبَ قَالَ قَالَ لِي أَبُو عَبْدِ الله (عَلَيْهِ الْسَّلام) دَمَانِ فِي الإِسْلاَمِ حَلاَلٌ مِنَ الله لاَ يَقْضِي فِيهِمَا أَحَدٌ حَتَّى يَبْعَثَ الله قَائِمَنَا أَهْلَ الْبَيْتِ فَإِذَا بَعَثَ الله عَزَّ وَجَلَّ قَائِمَنَا أَهْلَ الْبَيْتِ حَكَمَ فِيهِمَا بِحُكْمِ الله لاَ يُرِيدُ عَلَيْهِمَا بَيِّنَةً الزَّانِي الْمُحْصَنُ يَرْجُمُهُ وَمَانِعُ الزَّكَاةِ يَضْرِبُ عُنُقَهُ. عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ عَنْ مُوسَى بْنِ سَعْدَانَ عَنْ عَبْدِ الله بْنِ الْقَاسِمِ عَنْ مَالِكِ بْنِ عَطِيَّةَ عَنْ أَبَانِ بْنِ تَغْلِبَ عَنْ أَبِي عَبْدِ الله (عَلَيْهِ الْسَّلام) نَحْوَهُ.

5. A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Hassan ibn Shammun from ‘Abd Allah ibn ‘Abd al-Rahman from Malik ibn ‘Attiyyah from Aban ibn Taghlib who has said the following: “Abu ‘Abd Allah , said to me, ‘Allah has made it lawful, in Islam, to destroy two kinds of lives. No one can issue judgment about it until the rise of a person from our Ahl al-Bayt. When Allah, the Most Majestic, the Most Glorious, allows this person from our Ahl al-Bayt, he then judges them according to the laws of Allah without calling any witness to testify. One such life is the life of an already married fornicator who is stoned to death and one who refuses to pay zakat due on him who is beheaded (for this crime).”’ A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from Muhammad ibn Ali from Musa ibn Sa’dan from ‘Abd Allah ibn al-Qasim from Malik ibn ‘Atiyyah from Aban ibn Taghlib from abu ‘Abd Allah a similar Hadith.”
