Chapter 149 | Causing Losses ( Dirar )

6- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ هِلالٍ عَنْ عُقْبَةَ بْنِ خَالِدٍ عَنْ أَبِي عَبْدِ اللهِ قَالَ قَضَى رَسُولُ اللهِ ﷺ بَيْنَ أَهْلِ الْمَدِينَةِ فِي مَشَارِبِ النَّخْلِ أَنَّهُ لا يُمْنَعُ نَفْعُ الشَّيْءِ وَقَضَى ﷺ بَيْنَ أَهْلِ الْبَادِيَةِ أَنَّهُ لا يُمْنَعُ فَضْلُ مَاءٍ لِيُمْنَعَ بِهِ فَضْلُ كَلإ وَقَالَ لا ضَرَرَ وَلا ضِرَارَ.

Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Muhammad ibn ‘Abd Allah ibn Hilal from ‘Uqbah ibn Khalid al-Husayn from Muhammad who has said the following: “About the case of a man who dug a canal in a hill and it dried up another canal, abu ‘Abd Allah , has said, ‘They can divide and find out which one is harming the other by closing the flow of water of each canal and leave the other open and alternate by one night between the two (to measure the difference of increase and decrease of the level of water in each one).”’
