4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Mu‘awiyah ibn Wahab who has said the following: “This is concerning my question before abu ‘Abd Allah , about the case of a man who marries a woman and afterwards finds out that she had committed fornication. He (the Imam) said, ‘If the husband wants he can take back from her guardian the mahr that he has paid, but she deserves the mahr because of which her marriage was made lawful, and if he wants he can separate from her (by means of divorce).”’
