Chapter 56 | Marriage Without Guardian
2- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي عَبْدِ اللهِ قَالَ الْجَارِيَةُ الْبِكْرُ الَّتِي لَهَا أَبٌ لا تَتَزَوَّجُ إِلا بِإِذْنِ أَبِيهَا وَقَالَ إِذَا كَانَتْ مَالِكَةً لأمْرِهَا تَزَوَّجَتْ مَتَى شَاءَتْ.

Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from Abu Maryam who has said the following: “Abi ‘Abdillah , has said, ‘The virgin bondmaid who has a father must not marry without his permission.’ He (the Imam) said, ‘If she has control over her affairs she can marry whenever she wants.’”
