Chapter 70 | Marriage with Virginity Stipulation

1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ خَالِدٍ عَنْ سَعْدِ بْنِ سَعْدٍ عَنْ مُحَمَّدِ بْنِ الْقَاسِمِ بْنِ فُضَيْلٍ عَنْ أَبِي الْحَسَنِ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ عَلَى أَنَّهَا بِكْرٌ فَيَجِدُهَا ثَيِّباً أَيَجُوزُ لَهُ أَنْ يُقِيمَ عَلَيْهَا قَالَ فَقَالَ قَدْ تُفْتَقُ الْبِكْرُ مِنَ الْمَرْكَبِ وَمِنَ النَّزْوَةِ.

1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn Khalid from Sa‘d ibn Sa‘d from Muhammad ibn al-Qasim ibn Fudayl who has said the following: “About the case of a man who marries a woman as a virgin but finds that she is not virgin; if it is permissible to live with her, abu al-Hassan has said, ‘At certain times it is torn because of riding or jumping.’”
