Chapter 79 | Marriage with a Woman Divorced Against the Sunnah

3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَفْصِ بْنِ الْبَخْتَرِيِّ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً فَأَرَادَ رَجُلٌ أَنْ يَتَزَوَّجَهَا كَيْفَ يَصْنَعُ قَالَ يَدَعُهَا حَتَّى تَحِيضَ وَتَطْهُرَ ثُمَّ يَأْتِيهِ وَمَعَهُ رَجُلانِ شَاهِدَانِ فَيَقُولُ أَطَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ تَرَكَهَا ثَلاثَةَ أَشْهُرٍ ثُمَّ خَطَبَهَا إِلَى نَفْسِهَا.

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hafs ibn al-Bakhtariy from Ishaq ibn ‘Ammar who has said the following: “About the case of a man who divorces his wife three times and then another man wants to marry her and about what he must do, abu ‘Abd Allah , has said, ‘He must wait until she experiences one cycle of menses; then he must go to the man who has divorced her and ask him in the presence of two people, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her, then he must leave her alone for three months, then propose to her for marriage.’”
