Chapter 82 | Women who Become Unlawful for Marriage Forever

6- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَمُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ وَ ابْنِ مُسْكَانَ عَنْ سُلَيْمَانَ بْنِ خَالِدٍ قَالَ سَأَلْتُهُ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فِي عِدَّتِهَا قَالَ يُفَرَّقُ بَيْنَهُمَا وَإِنْ كَانَ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَيُفَرَّقُ بَيْنَهُمَا فَلا تَحِلُّ لَهُ أَبَداً وَإِنْ لَمْ يَكُنْ دَخَلَ بِهَا فَلا شَيْءَ لَهَا مِنْ مَهْرِهَا.

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from Sama‘ah and ibn Muskan from Sulayman ibn Khalid who has said the following: “I once asked him (the Imam) , about the case of a man who married a woman during her waiting period. He (the Imam) said, ‘They must separate from each other; and if he has gone to bed with her he must pay mahr (dower) for making his going to bed with her lawful. They must separate from each other and she is not lawful for him forever. If he has not gone to bed with her she does not have any mahr (dower).”’
