Chapter 84 | Marriage with Two Sisters at the Same Time: Free or Slave-girls

13- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ ابْنِ مُسْكَانَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ قَالَ قُلْتُ لَهُ رَجُلٌ طَلَّقَ امْرَأَتَهُ فَبَانَتْ مِنْهُ وَلَهَا ابْنَةٌ مَمْلُوكَةٌ فَاشْتَرَاهَا أَيَحِلُّ لَهُ أَنْ يَطَأَهَا قَالَ لا وَعَنِ الرَّجُلِ تَكُونُ عِنْدَهُ الْمَمْلُوكَةُ وَابْنَتُهَا فَيَطَأُ إِحْدَاهُمَا فَتَمُوتُ وَتَبْقَى الأخْرَى أَيَصْلُحُ لَهُ أَنْ يَطَأَهَا قَالَ لا.

13. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ibn Muskan from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah , about the case of a man who divorces his wife and they become strangers to each other. She has a daughter who is a slave and he buys her; if he can go to bed with her. He (the Imam) said, ‘No, he cannot do so.’ I asked him (the Imam) about the case of a man who has a slave-girl and her daughter and he goes to bed with one of them, then she dies and the other is living; if he can go to bed with her. He (the Imam) said, ‘No, he cannot do so.’”
