Chapter 99 | The Need to Mention Conditions after Nikah
5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ سُلَيْمَانَ بْنِ سَالِمٍ عَنِ ابْنِ بُكَيْرِ بْنِ أَعْيَنَ قَالَ قَالَ أَبُو عَبْدِ اللهِ إِذَا اشْتَرَطْتَ عَلَى الْمَرْأَةِ شُرُوطَ الْمُتْعَةِ فَرَضِيَتْ بِهَا وَأَوْجَبَتِ التَّزْوِيجَ فَارْدُدْ عَلَيْهَا شَرْطَكَ الأوَّلَ بَعْدَ النِّكَاحِ فَإِنْ أَجَازَتْهُ جَازَ وَإِنْ لَمْ تُجِزْهُ فَلا يَجُوزُ عَلَيْهَا مَا كَانَ مِنَ الشَّرْطِ قَبْلَ النِّكَاحِ.

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Sulayman ibn Salim from ibn Bukayr ibn ‘A‘yan who has said the following: “Abu ‘Abd Allah , has said, ‘When you settle the conditions of al-Mut‘ah (advantageous marriage) with a woman and she agrees, marriage becomes binding; you can bring your prior condition after marriage, if she agrees it is permissible; if she does not agree it does not apply effectively to her; it was before marriage.’”
