Chapter 23 | The Matters Permissible in Endowment, Charity, Gift, Present, Providing Conditional Housing and Matters Permissible or otherwise for a Child and others

22- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ عَنْ أَبِي الصَّبَّاحِ عَنْ أَبِي عَبْدِ اللهِ قَالَ سُئِلَ عَنِ السُّكْنَى وَالْعُمْرَى فَقَالَ إِنْ كَانَ جَعَلَ السُّكْنَى فِي حَيَاتِهِ فَهُوَ كَمَا شَرَطَ وَإِنْ كَانَ جَعَلَهَا لَهُ وَلِعَقِبِهِ مِنْ بَعْدِهِ حَتَّى يَفْنَى عَقِبُهُ فَلَيْسَ لَهُمْ أَنْ يَبِيعُوا وَلا يُورِثُوا ثُمَّ تَرْجِعُ الدَّارُ إِلَى صَاحِبِهَا الأوَّلِ.

22. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ’Isma’il from Muhammad ibn ai-Fudayi from abu af-Sabbah ai-Kinaniy who has narrated the following: “Once abu ‘Abd Allah , was asked about al-Sukna ’ and al-‘Umra’ (permission to use a house for a certain period of time). He (the Imam) said, ‘If permission to use the house is given for his lifetime, then it must remain as the condition requires, if it is for his and the lifetime of those whom he leaves behind until they die, then they cannot sell it or inherit it, but they must return the house to its first owner.’”
