Chapter 23 | Son of a Brother with a Grandfather

10- وَعَنْهُ وَعَلِيِّ بْنِ عَبْدِ اللهِ جَمِيعاً عَنْ إِبْرَاهِيمَ عَنْ عَبْدِ اللهِ بْنِ جَعْفَرٍ قَالَ كَتَبْتُ إِلَى أَبِي مُحَمَّدٍ امْرَأَةٌ مَاتَتْ وَتَرَكَتْ زَوْجَهَا وَأَبَوَيْهَا أَوْ جَدَّهَا أَوْ جَدَّتَهَا كَيْفَ يُقْسَمُ مِيرَاثُهَا فَوَقَّعَ لِلزَّوْجِ النِّصْفُ وَمَا بَقِيَ فَلِلأبَوَيْنِ وَقَدْ رُوِيَ أَيْضاً أَنَّ رَسُولَ اللهِ ﷺ أَطْعَمَ الْجَدَّ وَالْجَدَّةَ السُّدُسَ.

10. It is narrated from the narrator of the previous Hadith and Ali ibn ‘Abd Allah all from Ibrahim from ‘Abd Allah ibn Ja‘far who has narrated the following: “I once wrote to abu Muhammad , and asked that a woman has died leaving behind her husband, her parents or her grandfather or her grandmother; how is the legacy distributed? He (the Imam) , signed the answer that said, ‘The share of the husband is one-half and the rest belongs to the parents. It is also narrated that the Messenger of Allah, provided for the grandfather and grandmother one-sixth.’”
