Chapter 62 | One who Dies without Leaving Behind any Heirs
1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ قَالَ مَنْ مَاتَ وَتَرَكَ دَيْناً فَعَلَيْنَا دَيْنُهُ وَإِلَيْنَا عِيَالُهُ وَمَنْ مَاتَ وَتَرَكَ مَالا فَلِوَرَثَتِهِ وَمَنْ مَاتَ وَلَيْسَ لَهُ مَوَالٍ فَمَالُهُ مِنَ الأنْفَالِ.
1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad ibn ‘Uthaman from af-Halabiy who has narrated the following: “Abu ‘Abd Allah , has said, ‘If one dies with indebtedness, on us is his debt and up to us are his dependents. If one dies leaving behind assets, it is for his heirs and if one dies leaving behind no guardians, his asset is part of public welfare fund.”’
